Terms of Service

1. Who we are

These terms are an agreement between you and Spectre (trading as “global privacy”, ABN [ABN]), an Australian business (“we”, “us”). They cover the purchase of a pre-configured phone from us, and your use of the setup portal at globalprivacy.tel (the “Portal”).

2. What we sell

We sell genuine Google Pixel handsets supplied with GrapheneOS, a third-party privacy-focused operating system, installed and configured through the Portal, together with a per-device connectivity bundle (a data eSIM, a Mullvad VPN account, and Threema licence details) handed over once at setup.

• We are not affiliated with Google, the GrapheneOS Foundation, Signal, Threema, Mullvad, or any eSIM carrier. Their products are governed by their own terms.
• GrapheneOS is installed from official GrapheneOS release servers and verified against published signing keys before anything is written to the device.

3. Setup codes and claim links

• Each order comes with a single-use setup code (or a claim link that reveals one). It entitles one device, once, to be flashed and provisioned with its connectivity bundle.
• Treat the code like cash: anyone who has it can consume it. We cannot restore a bundle consumed by someone you shared the code with.
• Codes may expire if unused for an extended period; contact us if yours has lapsed and we will reissue it against your order.
• An interrupted setup can be resumed; a completed setup cannot be re-run with the same code.

4. The setup process — what you acknowledge

• Installation runs locally in your browser over USB (Chrome or Edge on a computer, or Chrome on an Android device with an OTG cable). We never remotely access your phone.
• Flashing erases the device completely, including any data on it. Only connect a phone you intend to have wiped.
• The process unlocks the bootloader, installs GrapheneOS, then relocks the bootloader and verifies the lock before finishing.
• Do not disconnect the cable or power off the phone mid-flash. If something goes wrong, follow the on-screen recovery guidance or contact us — Pixel phones are designed so an interrupted flash is recoverable, but you must not force-stop it deliberately.
• The one-time handoff sheet (eSIM QR, VPN account, messaging credentials, profile PINs) is shown once. Save or print it before closing the page. We do not keep a copy — that is the point.

5. Your responsibilities

• You must be at least 18 and legally able to enter this agreement.
• You must use the device and the connectivity bundle only for lawful purposes. Privacy tools protect lawful privacy; they are not sold for use in unlawful activity, and we may refuse or cancel orders we reasonably believe are for unlawful use.
• You are responsible for your own credentials after handoff. Lost PINs, lost handoff sheets, or a wiped device generally cannot be recovered by us — by design, we hold no keys to your device.
• Third-party services (Mullvad, Threema, the eSIM carrier, Signal) are subject to their own terms and continued availability, which we do not control.

6. Prices, payment and cancellation

• Prices are in Australian dollars and include GST where applicable.
• Orders are confirmed once payment clears (or, for in-person sales, on the spot). We may cancel and refund an order at any time before the setup code is redeemed.
• Once a setup code has been redeemed and the connectivity bundle consumed, a change-of-mind refund is no longer available; your rights for faulty goods under the Australian Consumer Law are unaffected (see our Warranty).

7. Consumer guarantees and liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded.

Subject to that paragraph:

• We are not liable for loss caused by your failure to follow the on-screen setup instructions, deliberate interruption of a flash, loss of the handoff sheet, or use of the device contrary to these terms.
• We are not liable for indirect or consequential loss (including loss of data you chose to store on the device after handoff), and our total liability is otherwise limited, at our election, to replacing or repairing the device or refunding the price paid.
• Where a failure relates to services and cannot be excluded, our liability is limited to resupplying the services or paying the cost of resupply.

8. The Portal

• The Portal is provided for setting up devices purchased from us. Don’t probe, disrupt, or attempt to bypass its token, session, or verification controls.
• We may update, suspend, or discontinue Portal features. Your consumer rights in relation to a purchased device are unaffected.
• The Portal and its content are our property or licensed to us; the open-source software it installs remains subject to its own licences.

9. General

• These terms are governed by the laws of [STATE], Australia, and the courts of that state have non-exclusive jurisdiction.
• If part of these terms is unenforceable, the rest still applies.
• We may update these terms; the version published at globalprivacy.tel/terms at the time of your purchase applies to that purchase.
