Conditions of Use & Liability Notice

1. What this device is — and is not

Your device is an ordinary consumer smartphone — a genuine Google Pixel — privately configured by Australian Privacy Group (trading as global privacy) with GrapheneOS, an independent, open-source privacy and security operating system, together with a one-time connectivity bundle (a data eSIM, a Mullvad VPN account, and messaging credentials). It is a general-purpose consumer product, sold openly, and it exists for exactly one purpose: lawful personal and business use — keeping your data, your communications and your identity safe from malware, theft, scams, surveillance-for-profit and unauthorised access.

It is not designed, configured, marketed or supplied for concealing, committing or assisting unlawful activity of any kind. It is not a tool for putting yourself beyond the law, and we do not sell it as one.

2. Your responsibility — in full

From the moment the device (and its connectivity bundle) is handed to you, you alone control it and you alone answer for everything done with it. That includes, without limitation:

• Every use — every call, message, photo, recording, payment, download and communication made, received or stored on the device;
• Every app and service you install or sign in to, and your compliance with the terms and laws that govern them;
• Every person you allow to use it — if you lend the device, give it away or sell it on, you remain responsible for that choice;
• Every place you take it — including compliance with the laws of any other country;
• Every change you make after handover — software you install or flash, settings you alter, protections you switch off;
• Compliance with all applicable law — Australian federal, state and territory law, and the law of anywhere else you use the device, including laws on telecommunications, data protection, surveillance and cybersecurity.

Put plainly: we supply the device. What happens with it afterwards is your act, your choice and your legal responsibility — not ours.

3. Unlawful use — zero tolerance, zero liability

4. The laws that apply to your use

Your obligations under this notice are not theoretical. The laws of every Australian jurisdiction — and of any other country you take this device to — apply to your use of it, and complying with each of them is your responsibility, not ours.

Commonwealth of Australia

Commonwealth law applies wherever you are in Australia, including criminal law, telecommunications and interception law, surveillance law, lawful-access and assistance laws (under which courts can compel access to devices, and refusal is itself a serious offence), privacy law, consumer law and export-control law.

Every state and territory

Each of New South Wales, Victoria, Queensland, Western Australia, South Australia, Tasmania, the Australian Capital Territory and the Northern Territory has its own criminal law, surveillance and listening-devices law and police-powers legislation — including laws compelling access to devices under warrant, and in some jurisdictions specific offences concerning encrypted devices used in connection with crime — in each case as in force from time to time. Wherever you are in Australia, the law travels with you. Recording conversations, monitoring others, accessing systems without authority, or using this device in connection with any offence is regulated or criminalised in every Australian jurisdiction — and using an encrypted device changes none of that.

International use and other jurisdictions

If you take or send this device overseas, the law of that place applies to your use, including its criminal law, telecommunications law, border-examination powers and any restrictions on encryption or VPNs. Some countries license or ban civilian encryption outright; penalties can include seizure, fines and imprisonment. You are also the exporter, and must comply with Australian export and sanctions law. Some Australian offences reach conduct committed abroad — leaving the country does not always leave the law behind. Checking and complying with the current law of every place you use this device is your responsibility alone. We accept no liability for any consequence of your failure to do so.

5. Our liability — where it ends

To the maximum extent permitted by law, we are not liable for, and you release us from, any loss, damage, cost, penalty or liability arising from or connected with:

• your unlawful, improper or negligent use of the device or any related product or service, or such use by any person you permit to use it;
• the consequences of your own conduct — including criminal, civil or regulatory consequences you bring upon yourself through how you choose to use the device;
• content and communications — anything you or others create, send, receive, store or access using the device;
• third-party software, apps, networks and services — including GrapheneOS (developed and updated by the independent GrapheneOS project), app stores, mobile networks, VPN providers and messaging services, which are supplied by others under their own terms;
• modifications after supply — any change you make to the software or configuration after the device leaves us;
• loss of data where you have not maintained backups — we cannot recover your data, your PIN or your passphrase, and we hold no copies of them;
• use contrary to this notice or the law of any place of use — including seizure, confiscation or penalties imposed by any authority in any country.

6. Encrypted apps: Signal, Threema, SimpleX Chat and others

Your device may come with, or you may install, encrypted communication apps such as Signal, Threema and SimpleX Chat. Understand their status clearly:

• They are lawful, publicly available consumer apps, used by millions of people, businesses and governments worldwide;
• They are independent third-party services — developed, operated and updated by their own providers under their own terms and privacy policies, which you accept when you use them. We do not operate, control or guarantee them;
• How you use them is your responsibility — every message, call, group and file you send through any app is your act, subject to the same laws as any other communication. Encryption of a message does not change the legality of its content or purpose;
• We accept no liability for these apps — their availability, security, changes, or your use of them.

7. Modems, routers and eSIM connectivity

Routers, modems, hotspots and eSIMs we supply connect you through third-party networks we do not control. Coverage, speed and availability are not guaranteed and vary by location, network and provider. Some eSIM services are data-only and do not support voice, SMS or emergency calls — check your plan description and keep an alternative means of contacting emergency services. Identity verification may be required by law before certain services activate. VPN and network hardware must be used lawfully: the same responsibility rules in this notice apply to every connection you make through them, and to any network you operate using them.

8. Products and services this notice covers

This notice applies to every product and service we supply, under any of our brands (Australian Privacy Group, globalprivacy.tel / global privacy, Spectre and Spectre Sim — and Global Privacy Group, a former trading name), including:

• GrapheneOS smartphones — Google Pixel devices privately configured with GrapheneOS;
• Hardened iPhones — Apple iPhone devices configured in supervised mode with hardened settings;
• Privacy routers and modems — including GL.iNet travel routers and VPN-capable modems and hotspots;
• eSIMs and connectivity products — Spectre Sim and other SIM, eSIM, data and mobile connectivity services;
• Accessories, configuration services and support supplied with or for any of the above.

Every product above is supplied on the same basis: for lawful use only, with you responsible for how it is used — whichever device, service or combination you use.

9. Supply terms

• Setup codes are single-use. Each order includes one setup code (or a claim link that reveals one). It entitles one device, once, to be flashed and provisioned. Treat it like cash — anyone holding it can consume it, and a bundle consumed by someone you shared the code with cannot be restored. An interrupted setup can be resumed; a completed one cannot be re-run.
• Setup runs locally in your browser (Chrome or Edge) over USB. We never remotely access your phone. Flashing erases the device completely — only connect a phone you intend to have wiped, and do not disconnect it mid-flash.
• The handoff sheet is shown once. Your eSIM, VPN account, messaging credentials and profile PINs appear one time at the end of setup. Save or print them before closing the page — we keep no copy and hold no keys to your device, so lost credentials generally cannot be recovered by us. That is the point.
• Third parties. We are not affiliated with Google, the GrapheneOS project, Mullvad, Threema, Signal or any eSIM carrier; their products are governed by their own terms and availability. GrapheneOS is fetched from official release servers and signature-verified before anything touches your device.
• Prices and refunds. Prices are in Australian dollars and include GST where applicable. Once your setup code is redeemed and the bundle consumed, change-of-mind refunds are no longer available. Your rights for faulty goods are unaffected — see our Warranty.
• Consumer guarantees. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this notice excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded. Subject to that, we are not liable for indirect or consequential loss, and our total liability is otherwise limited, at our election, to repair, replacement or refund of the price paid.
• The portal. globalprivacy.tel is provided for setting up devices purchased from us. Do not probe, disrupt or attempt to bypass its token, session or verification controls. These conditions are governed by the laws of Australia.

10. Your consumer rights are not affected

Nothing in this notice excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If there is a genuine fault with your device or our work, you are fully protected — your consumer guarantees and our 12-month warranty against defects are set out in our Warranty. This notice is about one thing only: responsibility for how you choose to use the device.

11. Acceptance

By activating or using your device (or by redeeming a setup code on this portal), you confirm that you have read this notice, that you accept these conditions, that you are at least 18 years of age, and that you are acquiring and will use the device for lawful purposes only. If you do not accept these conditions, contact us before using the device and we will arrange a refund.
